The Post-Bulletin of Rochester reports Monday that Judge James Rosenbaum found in favor of Phillip David Schaub, saying the jail violated his constitutional rights to be free from cruel and unusual punishment.
The newspaper says the judge also found that Sheriff Steve VonWald was deliberately indifferent to Schaub's needs and put him at serious risk of injury.
The 42-year-old Schaub claims he suffered potentially life threatening medical consequences because of inadequate housing and medical treatment while in jail in 2003.
Gregory Griffiths, who represented the county, says they disagree with the ruling, which came out last Thursday. He says they have not decided whether to appeal.
